Our website and online store are hosted through Shopify, which provides the e-commerce platform that allows us to offer products and services to customers.

2. Eligibility and Website Use

By using this website, you confirm that you are at least the age of majority in your state or place of residence or that you have permission from a parent or legal guardian.

You may not use our website or products for any illegal or unauthorized purpose. You may not:

We make reasonable efforts to display product descriptions, colors, sizes, materials, photographs, prices, and availability accurately.

Colors may appear differently depending on lighting, photography, materials, printing methods, and screen settings.
Handmade, printed, laser-cut, leatherette, acrylic, embroidered, and specialty products may have minor variations.
Product measurements are approximate unless otherwise stated.
Packaging may vary.
Products may be changed or discontinued without notice.

Minor variations that do not affect the general function or overall design of a product are not considered defects.

4. Pricing and Availability

All prices are listed in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, product quantities, and availability may change without notice. We reserve the right to:

Correct pricing or product-information errors
Limit the quantity available for purchase
Discontinue products
Refuse or cancel orders
Restrict sales to certain customers, locations, or jurisdictions

If an order is canceled after payment has been processed, an appropriate refund will be issued to the original payment method.

5. Orders and Account Information

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information.

You are responsible for reviewing your order before submitting it, including:

Color
Customization details
Shipping address

We may contact you when additional information is needed to process an order. Failure to respond may delay or prevent order completion.

An order confirmation does not guarantee acceptance of an order. We reserve the right to refuse or cancel an order because of suspected fraud, incorrect pricing, inventory problems, payment issues, policy violations, or other reasonable business concerns.

6. Payment

Payment must be successfully authorized before an order is processed.

Available payment methods are displayed at checkout and may be handled by third-party payment processors. X Designz does not control the processing times, security policies, or approval decisions of outside financial institutions and payment providers.

You agree not to initiate an improper chargeback for an order that was accurately fulfilled according to the product listing and these policies. Customers should contact us first so we can review and attempt to resolve an order concern.

7. Custom and Personalized Orders

All custom and personalized orders are subject to additional requirements.

Customers are responsible for:

Providing usable, high-quality artwork
Confirming spelling, wording, colors, measurements, quantities, placement, and design details
Confirming they have permission to use submitted artwork, logos, photographs, trademarks, or other protected material
Reviewing and approving proofs before production

Production will not begin until required information and approval have been received.

Once a proof is approved or production begins, a custom order generally cannot be changed, canceled, returned, exchanged, or refunded.

Custom products may have minor differences in color, placement, cutting, texture, or size due to the materials and production process.

8. Customer-Submitted Artwork

By submitting artwork, logos, photographs, wording, designs, trademarks, or other material, you represent that:

You own the material or have authorization to use it.
Our production of the requested product will not violate another party’s copyright, trademark, privacy, publicity, or other rights.
The material is not illegal, threatening, hateful, defamatory, obscene, or otherwise prohibited.

You remain responsible for claims arising from material you submit.

We may refuse any design or order at our discretion, including designs that may violate intellectual-property rights or applicable laws.

Submitting artwork does not transfer ownership of that artwork to X Designz. However, you grant us the limited permission necessary to review, modify, format, reproduce, and manufacture the requested order.

We will not publicly share custom designs or finished custom products for marketing purposes without permission when the design contains confidential or personally sensitive information. General product photographs may otherwise be used unless an agreement states differently.

9. Intellectual Property

The content on this website—including the X Designz name, branding, graphics, photographs, product images, text, designs, layouts, logos, and original artwork—is owned by or licensed to X Designz and is protected by applicable intellectual-property laws.

Website content may not be copied, reproduced, republished, sold, distributed, modified, or used commercially without written permission.

Purchasing a physical product does not transfer ownership of the underlying artwork, design, photograph, trademark, or intellectual property unless a written agreement specifically states otherwise.

10. Product Application and Use

Customers are responsible for determining whether a product is appropriate for their intended surface, garment, hat, bag, equipment, or project.

Application results may vary depending on:

Fabric or surface type
Heat-press or iron temperature
Pressure
Application time
Adhesive type
Washing and care
Customer equipment and technique

Follow any available application instructions. X Designz is not responsible for damage caused by incorrect application, excessive heat, improper washing, misuse, alteration, or failure to follow instructions.

For best results, test application settings when possible before applying a product to a valuable item.

11. Shipping and Delivery

Shipping and processing estimates are not guaranteed delivery dates.

Delivery may be affected by carriers, weather, holidays, incorrect addresses, high-volume periods, supply problems, or other circumstances outside our control.

Customers are responsible for providing a complete and accurate shipping address.

Once an order has been transferred to the shipping carrier, carrier tracking information will be used to determine its delivery status. Additional shipping terms are explained in our Shipping Policy.

12. Returns, Refunds, and Cancellations

Returns, refunds, replacements, exchanges, and cancellations are governed by our Refund Policy.

Unless otherwise stated in that policy, custom products, sale merchandise, clearance products, promotional products, and used or applied products are final sale.

The Refund Policy is incorporated into these Terms of Service.

13. Promotions and Discount Codes

Discounts and promotional offers:

May have expiration dates
May exclude certain products or collections
May not be combined
May have minimum-purchase requirements
May be limited to one use per customer
May be changed or ended without notice unless prohibited by law

Discount codes must be entered correctly at checkout. Discounts generally cannot be applied after an order has been submitted.

Custom orders, bundles, special promotions, wholesale purchases, or other designated products may be excluded from discounts.

14. Wholesale Purchases and Resale

Wholesale eligibility, minimum quantities, pricing, and product restrictions may be subject to separate written terms.

Wholesale customers are responsible for complying with applicable resale, tax, labeling, safety, and consumer-protection requirements.

Wholesale pricing and access may be changed or revoked if account information is inaccurate, minimum requirements are not met, or wholesale privileges are misused.

15. Reviews, Comments, and Submissions

When you submit a review, comment, photograph, suggestion, or other non-confidential content, you grant X Designz permission to use, reproduce, edit, publish, and display that content for business and promotional purposes.

You agree that submitted content will not:

Violate another party’s rights
Contain false or misleading claims
Include unlawful, threatening, abusive, or obscene material
Contain malware or harmful code
Impersonate another person

We may remove submitted content at our discretion.

16. Third-Party Services and Links

Our website may contain links to or integrations with services operated by third parties, including Shopify, payment processors, shipping carriers, social-media platforms, and outside websites.

We are not responsible for the availability, content, policies, security, products, or actions of independent third parties. Your use of those services may be governed by their own terms and privacy policies.

Personal information submitted through the website is handled according to our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide customer service.

18. Prohibited Conduct

You may not use the website to:

Commit fraud or misrepresentation
Infringe intellectual-property rights
Harass, threaten, or harm others
Submit unlawful or malicious content
Collect another person’s personal information without authorization
Circumvent website security

You agree to indemnify and hold harmless X Designz and its owners, employees, contractors, service providers, and affiliates from claims, losses, liabilities, damages, and reasonable expenses arising from:

Your violation of these Terms
Your misuse of the website or products
Material or artwork you submit
Your infringement of another party’s rights
Your violation of applicable law

22. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms or a purchase from X Designz will be brought in a court with appropriate jurisdiction in Arkansas, unless applicable consumer law requires otherwise.

23. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

24. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by law.
